Coverage

The Provider Accreditation Agreement (Agreement) and these Terms and Conditions only apply to the Living Longer Living Stronger program; and where applicable, the Strength for Life program.

You must not embellish the relationship between us and you, or express or imply any relationship or affiliation between us and you or any other person or entity except as expressly permitted by the Agreement and these Terms and Conditions. For example, you must not express or imply that COTA Tasmania supports, endorses, sponsors or contributes money to any other brands, products or services that you offer, such as other fitness programs.

Limited license

You are granted the right to use images, text and other materials associated with the Living Longer Living Stronger program, as provided by COTA Tasmania. This permission is granted by COTA Tasmania solely for the purposes of: identifying you as an accredited Living Longer Living Stronger Provider; promoting participation in Living Longer Living Stronger; and supporting other marketing and promotions regarding Living Longer Living Stronger.

You must not modify the images, text or composition of the Living Longer Living Stronger logo or the COTA Tasmania logo. If you require specific assets not already provided by COTA Tasmania, please provide us with details of your requirements.

All business names, trading names, trade marks, domain names, images, designs, logos, patents, copyright and other assets remain the property of their respective owners; and the Agreement and these Terms and Conditions do not transfer any of those to you.

Limitation of liability and indemnity

COTA Tasmania and its employees shall not be liable for any loss, action, damage or injury suffered by the Program Provider and/or participants as a result of or in connection with the Agreement, Terms and Conditions or Living Longer Living Stronger program.

You agree to indemnify COTA Tasmania and its employees from and against:

• all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with your participation in the Living Longer Living Stronger program.

Termination

Either party may terminate the Agreement upon giving thirty (30) days notice to the other party at any time and without cause.

Upon termination of the Agreement, you shall immediately cease using any materials related to the Living Longer Living Stronger program.
